I'm getting this error " be careful not to assign twice the same layer / duik us talking about the pelvis layer which is not assigned to anything and when I leave the pelvis at none and continue to the tail and choose none / the layers get thorwn all over the place
is this known can someon help please

Hi,
This is explained in this topic:

You have to be careful of the order of the layers in the stack in the timeline.
In your example, I think moving temporarily the spine layer to the index 9 should fix the issue. You could bring it back to the index 2 after rigging
